A retailer is not required by law to exchange a clothing item, where the issue is simple that they do not fit. Retailers such as Marks and Spencer are well known for their returns policy: where a customer can return any unwanted clothing item as long as it was purchased within 35 days. If the retailer does publish a returns policy - such as Marks and Spencer - then they have a contractual obligation to adhere to it.
